Abstract :ÖZET 18 Nisan 1960’ta DP’nin kurduğu TBMM Tahkikat Komisyonu Türk siyasal tarihinde önemli bir yere sahiptir. Her şeyden önce bu komisyonun kurulması ve kararları toplumun muhalif kesimlerinin bir daha önü alınamayacak şiddetli tepkilerine neden olmuş; çok kısa bir süre sonra da ordu yönetime el koymuştur. Komisyon CHP’nin ve bir kısım basının yıkıcı faaliyetlerini araştırmak amacıyla kurulmuştur. Ancak Komisyona tanınan yetkiler ve komisyonun aldığı kararlar incelendiğinde, bu komisyonun işlevinin “araştırma”nın çok ötesinde olduğu anlaşılmaktadır. Bütün bunlardan, bu Komisyonunun DP iktidarına karşı olan her türlü muhalefeti sindirmek ve susturmak amacıyla kurulduğu anlaşılmaktadır. Komisyonun yetkileri ve aldığı kararlar incelendiğinde, bunların hem 1924 Anayasasına, hem de TBMM İçtüzüğüne aykırı olduğu görülmektedir. First of all, the formation and decisions of this committee gave rise to backlash of the dissident populations. Even the proclamation of the state of siege by the government did not ease this opposition. The military subsequently took over the government. The committee of inquiry was formed to investigate ‘destructive activities’ of the main opposition party insert ignore into journalissuearticles values(RPP); and the opposition press. As I study the powers given to the committee and its decisions, I have come to the conclusion that the aim of this committee was beyond mere ‘investigation’. Namely, its purpose was to suppress and intimidate all kind of opposition to the ruling party. Consequently, I have come to a view that the formation, the powers, and the some of the decisions of this committee were unconstitutional.
